Probate is the process whereby probatable assets or property, both real and personal, in a deceased individual’s name alone, are passed, subject to debts, liens and estate taxes if applicable, to other individuals.
If the decedent has a valid Last Will & Testament in place, a petition is filed with the appropriate Probate Court, the will is allowed, the executrix or executor is appointed and after a one year probate period, creditors are paid and the remaining assets of the estate are disbursed in accordance with the terms of the will.
If the decedent dies intestate or without a will, a petition for administration is filed with the Probate Court, the heirs or family members choose an administrator or administratrix or if they do not agree the Probate Court appoints one.  After the one year probate period, creditors are paid and the remaining assets of the estate are disbursed in accordance with the laws of intestacy.
